The Constitution doesn't make anything illegal, per se; nor any sort of penalties for any action. The Constitution is a document listing what's referred to as 'negative rights; iow, what the government cannot deny the country's free citizens. To have this right put back 50 years by a bunch of old men is very poor.
It also cost the Republican party at the polls.

But those have all been decided on.
