Federal Judge Hits Biden With A Restraining Order After He Signs Another Immigration EO Empty Federal Judge Hits Biden With A Restraining Order After He Signs Another Immigration EO

A federal judge ruled to stop Joe Biden's orders to end the deportation of illegal immigrants. Biden's orders are just another attempt to roll back Donald Trump's efforts to secure the United State's border and end the revolving door of illegals the US had faced in previous years. The decision to stop Biden's plan came after a Texas attorney filed a lawsuit on behalf of Texas taxpayers, calling the order illegal.

Fox News reported:

"A federal judge on Tuesday temporarily blocked President Biden’s attempt to put a moratorium on deportations for 100 days.

After Texas sued over the policy, the judge blocked Biden, via a temporary restraining order, from moving forward for 14 days.

Texas’ lawsuit claims that the administration would be violating an agreement it has with the Department of Homeland Security – and would require at least 180 days’ notice, as well as consultation, prior to implementing changes in immigration policy. It is unclear whether those terms are enforceable, but similar agreements were struck with several other states under the former administration."

Federal Judge Drew Tipton on Tuesday issued the order after Texas Attorney General Ken Paxton sued President Joe Biden's administration late last week alleging the moratorium is unconstitutional and violates an agreement between the Department of Homeland Security and Texas, Texas Tribune explained.

The orders to halt deportation was just of many Biden's orders issued without consideration of how it affected the American people. Biden was also hit with threats of a suit after his acting secretary violated treaties between the US Government and the Ute Native American tribe by halting an energy project that directly hurts the Ute economy and violated Native land rights. Paxton argued the state would face financial harm if undocumented immigrants were released into the state because of costs associated with health care and education, and said the moratorium would also lure others to come to Texas. Tipton, an appointee of former President Donald Trump who took the bench last year, agreed.

"Texas argues that 'the categorical refusal to remove aliens ordered removable will encourage additional illegal immigration into Texas,' thereby exacerbating its public service costs. Such injury is not, as a legal matter, purely speculative," he wrote. "The Court finds that the foregoing establishes a substantial risk of imminent and irreparable harm to Texas.

The American Civil Liberties Union of Texas, who filed a brief urging Tipton to deny Paxton's request, decried the ruling in a statement and argued Biden's move was legal.

I wouldn't fly them back to Haiti. I'd send them back exactly the way they entered.
Although flying them back will keep them from trying again so soon.
