Biden Admin Ask Supreme Court to Approve Cutting of Texas Border Razor Wire

In its latest legal battle with Texas, the Biden administration is asking the U.S. Supreme Court to approve the removal of razor wire placed along the southern border between the Lone Star State and Mexico.


In a petition filed Tuesday, the Department of Homeland Security (DHS) is pleading the Court to vacate an injunction that the U.S. Court of Appeals for the Fifth Circuit imposed in December that allowed Texas to keep its concertina-wire barriers along the Rio Grande. The appeals-court order bars U.S. Customs and Border Protection agents from removing the barriers unless in cases of medical emergencies, such as drowning or heat exposure.


“While Texas and the court of appeals believed a narrow exception permitting agents to cut the wire in case of extant medical emergencies would leave federal agents free to address life-threatening conditions, they ignored the uncontested evidence that it can take 10 to 30 minutes to cut through Texas’s dense layers of razor wire,” the court filing reads. “By the time a medical emergency is apparent, it may be too late to render life-saving aid.”


In addition to raising medical concerns, the petition argues that Border Patrol agents have the authority to access private land within 25 miles of the southern border and that state laws cannot prevent federal agents from carrying out their work.


“The court of appeals’ contrary ruling inverts the Supremacy Clause by requiring federal law to yield to Texas law,” the filing adds. “If accepted, the court’s rationale would leave the United States at the mercy of States that could seek to force the federal government to conform the implementation of federal immigration law to varying state-law regimes.”


The DHS is ultimately asking the Supreme Court to temporarily authorize the removal of Texas’s razor wire while the courts determine its legal validity.

Judge Alia Moses, who denied the original injunction, said she found at least 14 instances of wire-cutting, many of which did not involve emergencies.

One she focused on occurred on Sept. 20 where agents cut new holes in concertina wire even though there was already a hole 15 feet away. Agents also dropped a climbing rope to help illegal immigrants surmount the banks of the Rio Grande.

In another article it said that it takes 30 minutes to cut through so if anyone was drowning they'd already be dead so that's a farce.

The current estimate is 1200 have drown crossing the Rio Grande and not in the area where the wire is so if anything that wire is stopping illegals from crossing the wired area and is saving lives because its there as a deterrent . A border wall that can't be breached would save all the lives lost but that would be counterproductive to leftist - those deaths are an acceptable percentage to the cause .

We had a similar situation here years ago where one govt gave asylum to any illegal immigrants.
It encouraged them and killed many by drowning. That govt was voted out
The next govt said no illegal immigrants will ever get permanent residency. It stopped the flow of illegal immigrants

Its cheaper to use Pit Bulls that the ASPCA gets from all the dog fighting that they recover from the raids they pull in the backyards of these illegal aliens . Let them loose on the Mexican side and that outta put a little fear in them .

Securing the border should be one of the easiest things for this country to do. Instead, neither side wants to do the dirty work needed to ensure nobody would dare try to cross over.

Both sorry-ass "parties" welcome immigrants, but for different reasons. Leftists welcome illegals for votes and replacing whites, while conservatives welcome them for cheap labor and to signal to the other party how "anti-racist" they can be. The "Border Patrol" is nothing but a welcome wagon for immigrants.

So at the end of the day, it doesn't matter who you vote for; you will be replaced either way.
