I'm trying to find out more on this because it states that they were investigating why this happened .
With my luck it could be a BS internet post .

senators were suposed to be appointed by the governor of the respective state....but it was changed so they are elected by the people. This is what i have read. I think it was also on David Barton's site and he is excellent at research. you might look there for any reference to your post.

Even if it's true, it won't matter now. There are far too many law degrees in government and far too much money at stake to ever let a thing like this change the status-quo.

Further investigation found that it did exist and was passed as an amendment by the state of Virginia sometime at the beginning of the Civil War . The North may have dismissed the action because Virginia was soon to go Confederate . All history of it was whitewashed because of the obvious implications .Did the Northern states know that it may have been a legal issue when Virginia was allowed back in ? Did they make a ruling to disenfranchise any legal ruling put forth by the states that left ? It was buried but if Virginia was still an active US state when they voted on this than a big legal problem is being hidden .
